My Uber Driver Hit Another Vehicle, Now What?
Given the popularity of rideshare services, it is no wonder that companies such as Uber have an estimated 149 million users. While the convenience of taking an Uber may outweigh the expense, it does not come without risks.
From 2021 to 2022, there were 153 Uber-related fatalities, a 66% increase from the previous report. A foreboding statistic, accident-related injuries, and deaths are only projected to increase in the coming years with the ever-increasing demand for rideshare services.
If you or a loved one has been involved in an Uber accident, our Conway motor vehicle accident lawyer can help you determine your next steps.
Contact the Paramedics
If your Uber driver hits another vehicle, you should check to ensure nobody is injured (including yourself). If you suffer any cuts, bruises, or other apparent signs of injury, you should call 911 immediately. Also, if you are disoriented, nauseous, or confused, this warrants a call for an ambulance since these may be signs of a traumatic brain injury.
Contact the Police
Under South Carolina law, you must contact law enforcement if anyone is injured or if there is at least $1,000 in property damage following an accident. If your Uber driver tries to drive off, stop them. Fleeing the scene is a crime, punishable by imprisonment and fines.
Document Your Injuries and The Accident Scene
If you were injured, be sure to take photos of your injuries. This will preserve your right to pursue compensation for your injuries and other losses. Additionally, take pictures of the accident scene itself. Besides taking photographs of vehicle wreckage, documenting the intersection where the accident occurred can provide valuable information. For instance, if your Uber driver states that they hit another vehicle due to visibility issues, a picture showing a well-light intersection can refute your driver’s testimony.
Contact Information of All Motorists Involved in the Crash
Collecting the following information will streamline your ability to make an insurance claim:
- Take a screenshot of the Uber app, including your driver’s name and vehicle make/model
- Full names of all drivers involved, phone numbers, and e-mail addresses
- Take a photo of driver’s licenses and license plate numbers
- Take a photo of each driver’s insurance card (insurance carrier and policy numbers will be included on the card)
Notify Uber About the Accident
If you were involved in an accident while riding in an Uber, a link on the Uber website allows you to report the accident. Once you file your report, a representative from Uber will contact you to ask you questions about the crash. In a situation where your Uber driver is at fault, Uber does offer the following third-party liability coverage:
- $50,000 for bodily injury claims per person
- $100,000 for bodily injury claims per accident
- $25,000 in property damage per accident
