How to Get a Restricted License After a DUI in South Carolina

Losing your driving privileges after a DUI arrest creates immediate hardship that significantly impacts your daily life. Getting to work, taking children to school, attending medical appointments, and handling basic errands become overwhelming challenges without a valid license.

South Carolina law provides several options for obtaining limited driving privileges during a suspension period, though eligibility depends on your specific circumstances and prior record. At Brad L Richardson, our DUI defense attorney helps clients explore every available avenue for restoring their ability to drive legally.

Temporary Alcohol License

When your breath test result exceeds 0.15%, or you refuse testing, law enforcement will arrest you and confiscate your driver’s license immediately. However, you may obtain a Temporary Alcohol License that allows you to continue driving for a limited period while your case proceeds through the administrative and criminal justice systems.

Obtaining one requires paying a $100 fee to the DMV. You must request an administrative hearing within 30 days of your arrest to challenge the suspension.

The Temporary Alcohol License remains valid until the hearing officer issues a final decision. If you fail to request a hearing within this window, your suspension takes effect automatically, and you lose access to this temporary driving privilege.

Provisional Driver’s License

South Carolina allows certain DUI offenders to obtain a provisional license that permits limited driving during their suspension period. South Carolina law establishes the requirements and restrictions governing provisional licenses. You must meet specific criteria and complete certain steps before the Department of Motor Vehicles will issue this credential:

Route Restricted License

South Carolina law permits eligible drivers to obtain a route-restricted license only once in their lifetime, and this option applies only to license suspensions, not revocations. If you previously received a route-restricted license for any reason, you cannot obtain another one regardless of how much time has passed:
